Selling or letting your property in Marrakech

To sell or let, first gather the title deed and a recent ownership certificate, then entrust the property by written mandate. A sale is registered within thirty days and the seller declares the real estate profit. A residential letting rests on a written lease, a condition report and a deposit of two months at most.

01 Preparing the file

  • Land title and a recent ownership certificate (land registry).
  • Plan and, for a building in co-ownership, the co-ownership rules and receipts for charges.
  • ID, and a power of attorney if you are represented: ask the notary for the current requirements.

02 The mandate

The written mandate states the length, any exclusivity, the asking price and the agency’s remuneration. Law 27-17 regulates the real estate agent profession; no legal scale sets the fees.

03 Selling: registration and tax

The deed of sale is registered within thirty days. The seller declares the real estate profit: 20% of the net profit, with a minimum of 3% of the sale price; a main residence occupied for five years on the date of sale is exempt.

04 Letting: lease and deposit

The residential lease falls under Law 67-12. It is written; the deposit does not exceed two months’ rent according to specialist sources; the condition report on entry and exit protects both parties.

Which document proves I am the owner?

For a registered property, the ownership certificate issued by the land registry, which names the owner and the charges. For an unregistered property, the deeds of ownership, to be examined by a notary.

Do I have to pay tax if I sell?

The seller declares the real estate profit: 20% of the net profit, minimum 3% of the sale price. A main residence occupied for at least five years on the date of sale is exempt, according to the DGI.

How much deposit should I ask a tenant for?

Two months’ rent at most for a residential property, according to specialist sources on Law 67-12. It is returned on exit, less sums owed and any damage found.
